Leverone Design, Inc. a California corporation (“Leverone,” “we,” “us,” or “our”) is committed to protecting personal information. This Privacy Policy describes how we collect, use, disclose, and otherwise process personal information when you visit or use https://leveronedesign.com/ and webpages that link to this Privacy Policy (collectively, the “Website”), contact us, or otherwise communicate with us in connection with the Website.

Your use of the Website is subject to our Terms of Use and Cookie Policy. This Privacy Policy does not apply to third-party websites, applications, or services that may be linked to or accessible through the Website; those third parties’ practices are governed by their own privacy policies.

 

Information We Collect

As used in this Privacy Policy, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

We may collect the following categories of personal information, depending on how you interact with the Website:

  • Contact and inquiry information, such as your name, email address, telephone number, organization, and the contents of communications you send to us.
  • Device, browser, and usage information, such as IP address, browser type, operating system, device identifiers, language preferences, referring URLs, pages viewed, links clicked, and the date and time of visits. WP Engine, our managed WordPress hosting provider, may process server logs that include this information to host, deliver, secure, and maintain the Website.
  • Communications information, including records of correspondence and contact details if you contact us.
  • Cookie and similar-technology information, including information collected through strictly necessary cookies and browser storage, and, if enabled, third-party video or accessibility technologies as described below and in our Cookie Policy.

Cookies Policy and Similar Technologies

We and our service providers may use cookies, local storage, session storage, server logs, and similar technologies to operate, secure, and provide the Website. The technologies identified in the current audit include:

  • WordPress and WP Engine. The Website uses WordPress and WP Engine hosting infrastructure. WordPress and WP Engine may use strictly necessary cookies for administrative authentication and preferences, including wordpress_test_cookie, wordpress_logged_in_*, wp-settings-*, wpe-auth, and wpEngineAdminBar*. These cookies are generally associated with authorized editors or administrators and are not intended to be set for ordinary public visitors.
  • Hotwire Turbo. The Website uses Turbo to support page transitions and caching. Depending on configuration, Turbo may use first-party in-memory or browser session storage to facilitate navigation.
  • Vimeo video content. The Studio page includes Vimeo video content. If the Vimeo player is configured to load when the page renders, Vimeo may receive information such as IP address, user agent, and referring URL and may use cookies or similar technologies, including vuid and player, for player functionality, preferences, analytics, and related purposes.
  • Accessibility control. The Website includes a footer “Accessibility” control. Its provider and technical behavior have not been identified.

You can manage non-essential cookies and similar technologies through the Website’s Cookie Settings. You may also manage cookies and browser storage through your browser settings. Blocking strictly necessary technologies may affect Website functionality. For additional information, please review our Cookie Policy.

We do not currently use advertising or retargeting pixels, social-media tracking widgets, embedded Google Maps, embedded Instagram feeds, chat widgets, or session-recording tools. Google Maps and Instagram are linked as third-party sites; they do not receive information from the Website merely because you visit it.

How We Use Personal Information

We may use personal information to:

  • Operate, maintain, secure, and improve the Website;
  • Respond to inquiries and communicate with you;
  • Evaluate and administer prospective or existing professional relationships, where applicable;
  • Provide and manage video or accessibility features you choose to enable or use;
  • Protect our rights, property, personnel, clients, and Website; comply with applicable law, legal process, and recordkeeping obligations; and carry out another purpose disclosed at the time of collection or with your consent, where required.

Marketing Communications

If you choose to subscribe to our mailing list or otherwise consent to receive marketing communications from Leverone, we may use your contact information to send you news, updates, event invitations, publications, and information about our services and projects. You may opt out of marketing emails at any time by selecting the “unsubscribe” link in the email or by contacting us at info@leveronedesign.com. Opting out of marketing communications will not affect our ability to send you non-promotional communications, including responses to your inquiries, notices about an existing client relationship, or other communications that we are permitted or required to send.

Disclosure of Personal Information

We may disclose personal information to:

  • Service providers supporting Website hosting, delivery, content management, security, IT, and communications, including WP Engine and Vimeo, if you enable or interact with Vimeo video content, subject to the player configuration and your consent where required;
  • The provider of the Website accessibility control, once identified, if you use that functionality;
  • Our professional advisers, including legal, accounting, insurance, and other advisers, where necessary;
  • Government authorities, regulators, courts, and other parties where required by law or reasonably necessary to protect rights, safety, or property; and
  • A buyer, successor, or other participant in a corporate transaction involving all or part of our business or assets.

We may also disclose information with your consent or at your direction. We may use and disclose aggregated or deidentified information where permitted by law.

We do not sell personal information for monetary consideration.

Disclosure of Personal Information

We use reasonable administrative, technical, and organizational measures designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure. However, no Internet transmission or electronic-storage system is completely secure, and we cannot guarantee absolute security.

Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including responding to inquiries, operating and securing the Website, maintaining business records, complying with legal obligations, and resolving disputes. The applicable retention period depends on the type and sensitivity of the information, the purpose of processing, legal requirements, and our legitimate business needs.

Privacy Requests and State Privacy Rights

To ask about our privacy practices or request access to, correction of, or deletion of personal information that you have provided to us, contact us using the Contact Us page or at info@leveronedesign.com. We will consider and respond to requests in accordance with applicable law and may need to verify your request.

Your California Privacy Rights (CCPA Notice)

This section applies to visitors, clients, and other individuals who reside in the State of California and is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (the “CCPA”). Any terms defined in the CCPA have the same meaning when used in this section. This section supplements the other disclosures in this Privacy Policy.

Categories of Personal Information We Collect

We collect, and may have collected in the preceding 12 months, the following categories of personal information, which we do not sell or share:

  • Identifiers, such as real name, email address, telephone number, and Internet Protocol (IP) address. Source: directly from you (for example, from the forms you complete and communications you send us) and, for IP addresses, indirectly from your device.
  • Internet or other electronic network activity information, such as browsing history on the Site and information regarding your interaction with the Site, collected through server logs and, with your consent, Google Analytics (see Section 5), indirectly from you by observing your actions on the Site.
  • Geolocation data, limited to the approximate location inferred from your IP address; we do not collect precise geolocation data.

We do not collect the following categories of personal information: characteristics of protected classifications under California or federal law; commercial information; biometric information; audio, electronic, visual, thermal, olfactory, or similar information; professional or employment-related information; education information; inferences drawn from personal information to create a profile about a consumer; or sensitive personal information.

Personal information does not include publicly available information lawfully made available from government records, deidentified or aggregated consumer information, or information excluded from the CCPA’s scope. We will not collect additional categories of personal information, or use the personal information we collect for materially different, unrelated, or incompatible purposes, without providing you with notice.

Use, Disclosure, Sale, and Retention

We collect personal information for the business purposes and disclose it only to the recipients described above. We do not, and have not in the last 12 months, sold personal information, and we have not shared personal information for cross-context behavioral advertising, and we have no actual knowledge that we sell or share the personal information of consumers under 16 years of age. We retain personal information only as described above.

Your Rights Under the CCPA

California residents have the rights listed below. These rights are not absolute, and we may be entitled to refuse requests, in whole or in part, where an exception under applicable law applies.

  • Right to Know and Access. You have the right to request that we disclose the categories of personal information we have collected about you; the categories of sources of that information; the business purposes for collecting it; the categories of personal information we have disclosed and the categories of recipients; and the specific pieces of personal information we hold about you. You also have the right to receive your personal information in a structured, commonly used format so that it can be transmitted to another entity (“data portability”).
  • Right to Delete. In certain circumstances, you have the right to request that we delete personal information we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete, and direct our service providers to delete, your personal information from our records, unless an exception applies.
  • Right to Correct. In certain circumstances, you have the right to request correction of inaccurate personal information. Upon verifying a valid correction request, we will use commercially reasonable efforts to correct your personal information as directed, taking into account the nature of the personal information and the purposes of maintaining it.
  • Right to Opt Out of Sale or Sharing. You have the right to opt out of the sale of your personal information and of its sharing for cross-context behavioral advertising. Because we do not sell personal information and do not share it for those purposes, there is no sale or sharing to opt out of.
  • Right to Limit Use of Sensitive Personal Information. We do not collect sensitive personal information as defined by the CCPA, so this right does not apply to our processing.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods or services; charge you different prices or rates (including through discounts, benefits, or penalties); provide you a different level or quality of goods or services; or suggest that you may receive any of the foregoing.

How to Exercise Your Rights

You may submit a verifiable consumer request by contacting us at info@leveronedesign.com. Except as provided under applicable law, there is no charge to exercise your rights. To verify your identity, we may ask you to provide your first and last name, email address, and/or telephone number, and to confirm information unique to you (such as the details of a prior inquiry). If we cannot verify your identity with the required degree of certainty, we may only be able to provide category-level information, and we may be unable to fulfill some requests.

You may also use an authorized agent to submit a request on your behalf. We require a valid power of attorney or other documentation signed by you demonstrating the agent’s authority to act, which must be included with the request.

Response Timing and Format

We will confirm receipt of a request within 10 business days and endeavor to respond substantively within 45 days of receipt. If we require more time (up to 90 days total), we will inform you of the reason and extension period in writing. We will deliver our response by mail or electronically, at your option, and any disclosure will cover the 12-month period preceding receipt of the request. Our response will explain any reasons we cannot comply with a request.

We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that a request warrants a fee, we will tell you why and provide a cost estimate before completing the request; alternatively, as permitted by the CCPA, we may refuse to act on such a request and notify you of the reason. If you wish to appeal a decision, please contact us at info@leveronedesign.com and clearly denote that it is an appeal.

International Visitors

The Website is operated from the United States. If you access the Website from outside the United States, you understand that personal information may be processed in the United States and other jurisdictions where our service providers operate, which may have data-protection laws that differ from those in your jurisdiction.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page and revise the “Last Updated” date above.
